MANILA, (PNA) — Customs Commissioner Rozzano Rufino “Ruffy” Biazon Thursday expressed hope the 15 Customs Collectors affected by the reassignment will not hold on to their post if the court will not extend the temporary restraining order it issued.
The 72-hour TRO issued by Manila Regional Trial Court Executive Judge Marino Dela Cruz against the assailed Customs Personnel Order will expire Friday.
In the said CPO, the petitioners are relieved from their present post and reassigned them to the Customs Policy Research Office which is directly under the Department of Finance.
According to Biazon, if the petitioners will not get an extension of the TRO, they are obliged to implement the CPO, hence, the affected Customs Collectors should abide by the CPO.
Judge Felicitas Laron Cacanindin of the Manila RTC Branch 17 will hear Friday the said case whether there is a need to extend the TRO.
The case will be heard Friday at 9 a.m. wherein the respondents and the petitioners were required to appear before the court.
The petitioners argued the CPO violated the 1987 Philippine Constitution, particularly their right to security of tenure.
They said the issuance of the CPO was immediately done pursuant to Executive Order 140 which was published only on Sept. 17, 2013.
They added if the Civil Code will be complied with, the CPO should take effect only on Oct. 2, 2013.
