DOJ wants Napoles’ counsel cited for contempt

Posted on September 28, 2013

MANILA, (PNA) — The Department of Justice is set to ask the Makati City Regional Trial Court to cite Atty. Lorna Kapunan in contempt of court.

“I instructed the handling prosecutors, thru PG (Prosecutor General Claro A.) Arellano, to formally ask the RTC-Makati to cite Atty. Lorna Kapunan in contempt of court for arguing their case and presenting alleged evidence before the media while the bail hearings are yet ongoing,” De Lima said in a text message Saturday.

Kapunan presented to the media Friday during the bail hearing of her client businesswoman Janet Lim Napoles alleged pieces of evidence purportedly showing that whistle blower Benhur Luy was not detained by Napoles and her brother Reynald Lim in a condominium unit in Taguig City last December.

“Her (Kapunan) actuation yesterday (Friday), right after coming out of the courtroom during a break (I surmise, a lunch break), are clearly violative of the subjudice rule,” De Lima said.

Makati City RTC Branch 150 Presiding Judge Elmo Almeda is hearing the bail petition of Napoles on the case of serious illegal detention filed by Luy against her and her brother Reynald.

Luy has also alleged Napoles is the “brains” behind the P10-billion pork barrel scam and the P900-million Malampaya fund scam involving some lawmakers and other former and current government officials.
