MANILA, (PNA) — The Manila City Prosecutor’s Office on Thursday dismissed the perjury case filed by the alleged pork barrel scam queen Janet Lim Napoles against Benhur Luy and other whistle blowers.
This was contained in an 11-page consolidated resolution recommended by handling prosecutor Philger Noel Inovejas and approved by Senior Deputy City Prosecutor Eufrosino Sulla.
Aside from Luy, also charged by Napoles are his parents Arturo and Gertrudes and brother Arthur, as well as another whistle blower Merlina Sunas, former employee of the JLN Corporation.
Napoles used as basis in filing the complaint the respondents’ sworn statements submitted to the Department of Justice stating that Benhur remained in her custody against his own free will.
In the resolution of the MPO, the complaint was dismissed for lack of sufficient evidence.
Because of this, there was no probable cause to file the case in court.
The resolution also said Napoles failed to prove that the allegations of the respondents were incorrect pertaining to the illegal detention of Benhur Luy.
Napoles also failed to disprove the allegations of the respondents on her alleged involvement in anomalous transactions using government funds.
